    Citizenship: USA, currently on tier 4 expiring January 23rd, looking to switch to Skilled Worker Visa.

    I am currently on a tier 4 visa, and I got a job offer just before the holidays and I began full time work last week (my tier 4 visa allows for full time work when it is not during the academic session). My tier 4 visa expires January 23rd 2021.

    The company agreed to sponsor my visa, and the pathway from tier 4 to skilled worker visa is normally straightforward, but, they did not have a sponsorship license. They are a small company and it took them a while to get organized; they have only just submitted the business sponsorship license today. It supposedly takes 10 business days when sent as a priority application (which they did).

    What are the chances I will still be able to apply for a Skilled Worker visa from within the UK? In order for that to be possible, I need the company to be able to issue me a CoS before the 23rd.

    – IF this is not possible, how long do you think the entire process will take for me to fly to the U.S. and apply for my visa from outside the U.K.?

    – Does it delay the process further that the company would need to provide me with a defined CoS for applying from outside the U.K., rather than an undefined CoS, or is it the same timeline?

    – What kind of documentation is acceptable for qualifying for Exceptional Assurance and remaining in the U.K. past the expiration date of my visa on Jan 23rd? Would this allow me to apply to with a CoS for Skilled Worker status as though I was still on a valid tier 4?

    – Also…. can I work while I wait for my application results? I noticed something on the Gov website that made me unsure as the language used to phrase this was a bit tricky.

    So sorry for all the questions but I cant afford an immigration lawyer and the company hasn’t hired one. I worked super hard for this job and I am not sure where I would go if I had to leave the U.K. Thanks in advance for your help!!!!!!
